Child Support
Northwest Suburban Chicago Child Support Attorneys
If you are a custodial parent in Illinois, you may be having difficulty collecting child support or you may have reason to believe that your ex-spouse is not disclosing all of his or her income. As the noncustodial parent, you may have had a change in circumstance and need an adjustment in your child support. Or you may have simply been served with a new support order that you believe is unfair.
Whether you are the custodial or the noncustodial parent, you want a realistic assessment of your options and your likelihood of success. At the Law Offices of Allen S. Gabe & Associates, P.C., in Schaumburg, we help you develop meaningful strategies to provide for your children or meet your child support obligations. Some of the questions we hear from clients regarding child support include the following:
- How much support will I have to pay?
- How is child support calculated?
- My ex-spouse receives commission pay, is this factored into the amount of support she will pay?
- What about my overtime pay or my bonuses – do these count in support determinations?
- I am self-employed, how can the court fairly and accurately determine the amount of support I can afford?
- I was recently laid-off and can’t afford my child support payments – what can I do?
Temporary child support while your case is pending
If you have just filed for divorce and are seeking custody, we will work quickly to petition for temporary child support so that you will have the financial support you need during the legal process. If you have been unable to meet your child support obligations because you have lost a job or have had medical problems, we will defend you. In Illinois, you can go to jail or lose your driver's license for failure to pay child support. We can often avoid these sanctions if we can show good reason why you were unable to make your support payments.
Some of the issues that lead to child support disputes include:
- Correct calculations for a self-employed noncustodial parent
- Correct calculations for a seasonally employed or underemployed noncustodial parent
- Child support obligations from prior relationships
- A child with a disability or chronic medical or behavioral condition
- A gifted child
Regardless of the special circumstances, we will work closely with you to ensure that you are well-informed and that you make decisions that are in your best interests and the best interests of your children. We know how to obtain bank statements and credit card statements, and how to use them to show evidence of income.
